この記事は TED コーパスをお使いのユーザーへの経過報告です。

TED との話し合いはまだ道半ばですが、これからも皆様に安心して使っていただけるよう努めます。

外国語教育メディア学会（LET）関東支部運営委員会および同執行部による「TEDコーパスについては、TEDの許諾がない限り、研究発表はできない」（⇒記事）との通告を受ける形で、研究プロジェクト代表の山口氏が、TED とのやり取りを始めたのは昨年の秋であった。

当初は、的の外れた返答であったり、しばらく返事がなかったりと、雲をつかむようなやり取りが続いた。

要領を得ない応答が続く間には、TEDコーパスに関わる研究発表（⇒記事１ ⇒記事２）を行なったり、コーパス構築を専門的に手がけている学会の論文検索エンジンを開発（⇒記事）したりしていた。

そして５月１日に出したメールに２週間以上も返事が来ないことがあり、５月１７日に再度同じ内容を送信したが、再び応答がない日が２週間３週間と続いた。

そこで１ヶ月以上経った６月２０日に、以下のメールを送信した。返事がないことに対してのこちらの対応を知らせる趣旨であった。

We would first like to express our sincere apology on re-sending our email, although you state the TED Talks Usage Policy and the Creative Commons BY-NC-ND license on your website.

We sent an e-mail about two months ago, but did not receive any reply. This is the second edition of it.

Mr. Tabuchi and I have received two suggestions, which are applying media license request and formal licensing partnership with TED. But we think we have not been able to make you understand what we would like you to understand.

We respect the TED Talks Usage Policy and the Creative Commons BY-NC-ND license, and Mr. Tabuchi has been and will be developing both educational sites of him: TED Corpus of Most Viewed 360 and Search Engine for selected360, based on the usage policy and the Creative Commons license.

Although we have not received your reply permitting us to continue to do education research through the use of TED Corpus of Most Viewed 360 and Search Engine for selected360, we understand these websites of Mr. Tabuchi's do not infringe your organization, TED.

Are we to understand that we can use “selected360” and it’s search engine ( http://www.mintap.com/talkies/selected360.html ) for research and educational purpose?

We make a promise again to continue to respect your policy and to develop useful websites in order for learners of English to learn more through the TED Talks materials.

要は、返事がないので、TED コーパスには問題がないと判断するとの趣旨であった。

これで返事が来なければ、やり取りを終える心積もりであったが、１０日後に返事が来た。

Thanks for following up with us and apologies for the delay.

Unfortunately, the use of TED content in this way is not permitted under our Creative Commons license and does not comply with our usage policy. What you have described would not be authorized outside of a formal licensing relationship with TED. We ask that you please remove all content immediately and confirm once you have done so.

Please know that our response is consistent with similar requests. Thanks for your understanding.

TED とのライセンス契約がないのだから、サイトを削除してくれとの返事であった。

問題の TED コーパスのサイトについては、半年以上前の当初から URL を示していて、それについてやり取りしてきたわけであり、ライセンス契約をしていないことは双方の確認事項で、また、ライセンス契約を求めるものでないことは告げてあったので、「ライセンス契約がないから削除」の結論であれば半年以上かかるようなものではないと不思議に感じながらも、次のような返信をした。

2018/07/12 TED へのメール

We were surprised to read your email, because “TED Selections Most Viewed 360” is a kind of Web Search Engine like Google, Naver, etc. and we thought if there are any problems, we can modify them. But you say “remove all content”.

We are going to remove all content that infringe on TED's copyright, so please tell us which items are infringing. "TED Selections Most Viewed 360" page has a lot of filters, helps and "this week's choice". Each "this week's choice" has dozens of items such as "Contour map", "Image of the video linked to the TED Talk", "Headline", "Speaker Name", "Tags", "Topics", "Headline in Japanese", "Description", "Words list", etc.

TED says us to remove "all content", so we want to know the range of what you consider "all content".

"all content" とは具体的にどれを指すのかを確認するメールであった。

返事は１０日後にやって来た。

Thanks for reaching out to us. Within the range of content that we have discussed, we ask that you please remove all content under the full list, but not exhaustive list, that you have described. This includes all videos, metadata, and uses of the TED logo and branding.

読みづらい文章ではあるが、要は、前回のメールで列挙した要素は問題ではないこと、そして、問題なのは「videos, metadata, and uses of the TED logo and branding」であると主張しているのだった。

しかし、TED コーパス・サイトは検索エンジンなので、TED へのリンクは張っているが、TED のビデオやサイトそのものを使ってはいない。表示している情報はリンクを貼るために必要な引用の範囲である。また TED のロゴはどこにも使っていない。

どうも話がずれていると思いつつ、返信した。

2018/08/01 TED へのメール

We understand that the list we described in the previous email is not the content that you asked us to remove. And we understand that you asked us to remove "all videos, metadata, and uses of the TED logo and branding ".

The following [see the attached file] is one of searching results. Please teach us where are the elements that you pointed out, that is "videos, metadata, and uses of the TED logo and branding".

As to "TED branding ", we are going to add the following message. "This site is not the official site of TED, but a search engine specializing in exploring TED Talks. It has been created for educational and scientific purposes."

ある有識者は「アメリカに行って対面して話し会えば、解決するだろう」と助言してくれた。

TED コーパス（⇒TED Corpus of Most Viewed 360 / selected360 ）は、Google や Yahoo などと同様の検索エンジンで、所在検索サービスである。こうしたサービスは、日本では2009年の改正著作権法で初めて明記され、合法化されている。
